TM Headstart Application
A TM Headstart (TMHS) application is a fast turnaround search and filing service combined. It is effectively a preliminary application that allows applicants to receive an assessment of their proposed trade mark by an Examiner before proceeding publicly with a standard application. This is a very economic and efficient way of allowing applicants to gauge early on if a mark will run into any issues; and then make an assessment about proceeding with use and registration of the mark.
This process involves the following stages:
- Part 1 filing of the TMHS application (attracts Part 1 Fee per class);
- An Examiner will assess the mark and provide a report within 5 working days. Based on the results of the TMHS report, the applicant can then opt to either make amendments to the mark (attracts an additional fee) or proceed with a standard application (attracts Part 2 Fee).
- Optional Amendment: Depending on the results of the report, the applicant can opt to submit an amended or entirely new mark for reassessment. Any amendments must be submitted within 5 working days from the dates of the TMHS report. The Examiner will issue their reassessment within a further 5 working days.
- Part 2 filing then transforms the TMHS application into a standard application and the priority date of the application is the day the Part 2 fee is paid (attracts Part 2 Fee per class).
